1.1. PURPOSE OF POLICY.

Livby,LLC (“Livby,” also referred to herein as “us” or “we”) is committed to respecting the privacy rights of visitors to and users of (a) the website located at www.livby.live (together with any other Livby websites where we have posted this Privacy Policy, the “Sites”), and (b) the Livby application (together with any mobile products offered in connection with Livby application or any Site, the “Application”). As used in this Privacy Policy, “Services” refers to the Sites, any Application, and the content, software, and features that you can access and use from any of the foregoing. We created this Privacy Policy (this “Policy”) to give you confidence as you visit or use the Sites or the Application, and to demonstrate our commitment to fair information practices and the protection of privacy. This Policy is only applicable to the Sites, the Application and the other Services. This Policy does not apply to any third party websites that you may be able to access from the Sites or the Application, each of which may have data collection and use practices and policies that differ materially from this Policy, nor does it apply to any services that may be offered by our business partners, where your personally identifiable information is collected by anyone other than Livby, LLC. If you have any questions concerning the Sites, the Application, our other Services, this Policy, or anything related to any of the foregoing, we can be reached at the following email address: hello@livby.live

1.2. NOTICE CONCERNING CHILDREN

PLEASE NOTE: Our content is intended for a general audience and we operate a business that is targeted at adult clients and customers only, and we do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a user of this Application, our websites or our other Services is under age 13, we will promptly delete any personal information that might be stored about that user.

1.3. NOTICE REGARDING INTERNATIONAL USERS

Although the Sites and our other Services are hosted in, and are intended for users from, the United States, we strive to create a global community with consistent standards for everyone. We also strive to respect local laws. The following provisions apply to users and non-users who interact with Livby outside the United States:

1.4. DISCLAIMER REGARDING CONTENT AND SERVICES

REMEMBER: We have created the Sites and the Application for the purpose of providing entertainment, information, and other content and features that we believe our users will use and enjoy, and while we are always doing our best to monitor the content and information we make available, and while we endeavor to update the Sites, the Application and our other Services regularly, we do not guarantee the accuracy, currency, reliability or completeness of any content or information included here or on any site accessible from here, or that is otherwise available from the Sites or the Application. We expect that you will use your own skill and care in using the Sites and the Application and in relying on any information that may be available from the Sites or the Application. In order to use any Site or Application, you must review and agree to our Terms of Use, which include this Policy and which also include other important terms regarding the materials we make available on the Sites and in the Application.
WE DO NOT PRE-SCREEN OR APPROVE USERS, NOR TO WE REQUIRE USERS TO REGISTER WITH US IN ORDER TO ACCESS THE SERVICES, AND WE CANNOT GUARANTEE USER IDENTITIES OR ANY INFORMATION THAT USERS PROVIDE. YOU WILL HAVE SOLE RESPONSIBILITY FOR THE ACTIONS YOU TAKE IN CONNECTION WITH THE SITES OR THE APPLICATION. DO NOT PROVIDE PERSONAL INFORMATION TO ANY OTHER USER UNLESS YOU KNOW THAT USER AND KNOW WHAT HE OR SHE INTENDS TO DO WITH YOUR PERSONAL INFORMATION.

2. INFORMATION COLLECTION PRACTICES

2.1. WE COLLECT LIMITED PERSONAL INFORMATION ABOUT YOU

In operating the Sites and the Application, our practice is to collect limited personal information from our users. In particular, we may ask you for your email address so that we can send you updates and other information about the Livby application, and about changes and additions to the Sites, the Application and our other Services. If you provide us with your name when you give us your email address, then we will collect and keep your name with your email address, and our files will reflect that your name and email address belong to the same person. If you do not want us to contact you, then do not provide us with your email address or (if applicable) select “Please do not contact me” when we ask you to provide us with your preferences for how often you would like to be contacted by us. If, after you provide us with your email address or otherwise give us permission to contact you, you decide that you no longer want us to contact you, let us know (via the “Contact Us” page on any Site or by emailing us at the address set forth in Section 1.1 above) and we will delete your email address and any associated information from our files.
In providing the Sites and the Application, we may decide to ask you to select a password in order to secure your account, or perhaps to provide you with access to certain restricted areas of our Services. If we require or request a password from you, then maintaining the confidentiality of that password will be your responsibility, and we will not have any liability for your failure to maintain that confidentiality or to allow someone other than you to access and use any Site or the Application through your account.
In order to download and use the Application, you may have to maintain an account with iTunes or another third-party distributor of applications (“Distributors”), but any personal information you provide to a Distributor is between you and that Distributor (and you should be sure to review that Distributor’s privacy policy and information collection practices carefully); we will not be collecting personal information about our users from Distributors, or from other third parties with whom you may from time to time have contact in connection with the Sites or the Application. Even where we have collected limited personal information about our users, we will never sell or otherwise make available for a fee that personal information. We may sell all of our data in connection with certain corporate transactions related to Livby, LLC, though, so make sure you read the terms of Section 3.3 below carefully.
We do want you to tell your friends about Livby, and so on the Sites and in the Application we may include features through which you can help us spread the word by entering your friends’ email addresses, sharing with your friends via social media services or otherwise posting to social media services, sending tweets, and/or using email addresses from contacts stored on your mobile device, on your computer or in an online email account. In order to use our Services to email your friends, you will need to click “yes” if asked for permission to access any of your stored or online contacts or friends, and then the Services will use any email addresses or friend information that you select to send the desired message, but will not otherwise retain those email addresses or friend names in its files.
NOTE: We maintain a contact email address so that users can reach us with comments and questions, and we also may maintain a presence on Facebook, Twitter, and other social media platforms. If you communicate with us by e-mail, even if you have not previously provided us with your email address, we will use your email address if necessary in order to respond to you, and we may retain your email address in our files during and for a period after the time that we are in communication. We do not control the terms of use or privacy policies for any social media platforms in which we participate, and it will be solely your responsibility to familiarize yourself with their information collection practices and only disclose personal information (which will be collected by the third-party social media platform operators, and not by us) if you are in agreement with those information collection practices.

2.2. WE MAY COLLECT ANONYMOUS INFORMATION WHILE YOU USE THE SERVICES

AUTOMATIC COLLECTION. Our servers can automatically recognize visitors’ domain names and IP addresses and may also identify users’ computer/mobile device type and connection information, as well as information about browser type and browser settings and (where possible) geographic location. No personal information about you is revealed in this process. We may also use clear gifs (also known as web beacons) and other methods to gather anonymous “traffic data” that does not personally identify you, but that may be helpful for marketing purposes or for improving our Services. Clear gifs may also be used in email messages that we send to users and to your contacts that you permit us to email, so that we can track whether recipients have opened those messages.
COOKIES. From time to time, we may use the standard “cookies” feature of major browser applications that allows us to store a small piece of data on your computer about your visit to the Sites. We do not set any personally identifiable information in cookies, nor do we employ any data capture mechanisms on the Sites other than cookies. Cookies help us learn which areas of the Sites are useful and which areas need improvement. You can choose whether to accept cookies by changing the settings on your browser. However, if you choose to disable this function, your experience at the Sites may be diminished and some features may not work as they were intended. Promotions or advertisements displayed on the Sites or in the Application may also contain cookies, and we do not have access to or control over information collected by outside advertisers when you click on any such promotions or advertisements, whether on any Site or in the Application.

3. USE AND SHARING OF INFORMATION

3.1. WHAT DO WE DO WITH INFORMATION WE COLLECT?

You always have the option not to provide us with any personal information. If you do elect to provide any personal information to us, then we will use that personal information to communicate with you about the Sites, the Application and the other Services offered by us, or to comply with the law, and we will only disclose that information as follows:
As described in Section 5.1 below, we may allow you to connect with certain third-party social media services (such as Twitter, Facebook, Google+ and other similar services). If you do use the Sites or the Application to connect to a third-party service, please make sure you are familiar with and in agreement with the ways in which that third party service will share your personal information. Similarly, if you use the Sites or the Application to provide information to those third-party services (such as by authorizing us to update your Facebook status or to send Twitter an update that you have provided or created using the Services), the information will no longer be under our control, and will instead be subject to the privacy policies and other terms of use of those third party services. It is your responsibility to control whether your activities via the Sites or the Application are provided to third party services.
If you choose to use the Sites or the Application to contact friends about us or the Services, we will automatically send an email to each friend for whom you provide an email address. We store the email information you provide so that we can (a) send the initial email to your friends, and (b) monitor the effectiveness of our invitation services. Your friends may contact us at hello@Livby.live to request that we remove their email information from our databases. For friends that do not respond, or that do respond but do not elect to give us their email addresses for subsequent information and updates, we will delete those email addresses when we periodically purge our files.
We use anonymous information to analyze traffic and usage of the Sites and the Application, but we do not examine this information for individually identifying information. In addition, we may use anonymous IP addresses to help diagnose problems with our server, to administer the Sites, the Application and the other Services, or to display content according to your preferences, and we may use clear gifs (or similar features) to anonymously track how users are using the Sites, the Application and the other Services and to improve our reporting and marketing systems. Traffic and transaction information may also be shared with business partners and advertisers on an aggregate and anonymous basis.

3.2. IN WHAT CIRCUMSTANCES WILL WE DISCLOSE PERSONAL INFORMATION?

In addition to disclosures described above, we may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on us or our parent company, subsidiaries or affiliates, (2) protect and defend our rights or property or the rights or property of users of the Services, (3) enforce our Terms of Use or other agreements, or (4) protect the rights, property or safety of Livby, users of the Services, or others.

3.3. WHAT HAPPENS IF COMPANY IS ACQUIRED?

In order to accommodate changes in our business, we may sell our company or portions of our company or sell or buy portions of other companies or assets, including the information collected through the Sites, the Application and the other Services. We may also sell the Sites and/or the Application in connection with a deal for the sale or distribution of Livby. If Livby, LLC or substantially all of its assets are acquired, or if Livby is sold or licensed for distribution, user information may, in our sole discretion, be one of the assets transferred to the acquirer.

3.4. HOW CAN YOU ACCESS AND/OR REMOVE YOUR INFORMATION?

You can notify us at any time that you want to terminate our storage of your personal information, and upon receipt of that notice, we will remove all information about you from our database, at which point you will no longer receive email notices and updates from us. Unfortunately, we do not maintain any procedures for you to review or request changes to the information that we collect about you; your only option at this time is to request deletion of all personally identifiable information about you in our files. Also, keep in mind that any information or content that you have posted to public areas of third-party social media services may remain on those areas irrespective of the status of your user accounts with those social media services. The deletion of your personal information from our files will not cause the removal of any content you had previously provided to social media services, even if provided from the Sites or the Application or otherwise with the use of the Services.

4. SECURITY

Livby, the Sites and the Application have security measures in place to prevent the loss, misuse, and alteration of your content and information (including any data that you provide to us), both during transmission and while stored by us, but we make no assurances about our ability to prevent any loss, misuse, or alteration of such content or information, and we and our owners, partners and affiliates will have no liability to you or to any third party arising out of any such loss, misuse, or alteration. In addition, your social media account information should be protected by user names and passwords that you have selected, and it is up to you to protect the confidentiality of your account information and to prevent unauthorized access to your social media accounts. When you use any Services to tweet or to connect or post to any social media platform, you are authenticating with and posting to the applicable social media platform, and your login and password information will be processed by that platform. Except as specifically authorized on a Site or from within the Application, the Services will not save any of your social media account information as part of this process, and security of this information will be as provided by the applicable social media platform. You should back up your mobile device regularly (using the device backup options), so that you might be able to restore the Application in the event of loss of data or loss of the device.

5. AREAS BEYOND OUR CONTROL

5.1. SOCIAL MEDIA

The Sites and the Application may offer you access to various social media services (which may include, without limitation, Facebook, Twitter, and Google+), and those social media services may provide comment areas, message boards, public forums, and other publicly viewable communication platforms. Please remember that any information that is disclosed in many of these areas becomes public information (available to other users who are also participating in those areas and perhaps to the public in general), and we recommend that you exercise caution about disclosing your personal information when using any of these public forums. The terms of use and privacy policies applicable to each of those social media platforms will govern the information that you disclose there. We have no control over the use of any personal information disclosed in a public forum, and you are solely responsible for the effects of any such disclosure.

5.2. THIRD PARTY WEBSITES

The Sites and the Application may contain third-party advertising and links to other websites. If you choose to click on advertisements or visit other websites, we are not responsible for the privacy practices of those advertisers or other websites, and it is your responsibility to review their privacy policies and terms of use to confirm that you understand and agree with their policies. In addition, in no event will we have any responsibility for the contents of those advertisements or other websites, and you click on advertisements and visit and use third-party websites entirely at your own risk.

6. CONTACT INFORMATION AND POLICY UPDATES

6.1. CONTACTING US

If you have any questions about this Policy, our practices related to the Sites, the Application, or our Services, or if you would like us to remove your information from our database, please feel contact us using the contact information provided in Section 1.1 above.

6.2. UPDATES AND CHANGES

We reserve the right, at any time, to change, update, or modify this Policy, simply by posting the changed, updated, or modified Policy on the Sites and in the Application and without any other notice to you. Any such change, update, or modification will be effective as soon as the revised Policy has been posted. It is your responsibility to review this Policy from time to time to ensure that you continue to agree with all of its terms.
